Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of the CultureNest Pulse Terms of Service and applies to every Customer and User. Capitalized terms have the meanings in the Terms.
1. You may not
- Use the Service for any illegal, fraudulent, or harmful purpose, or in violation of any law or regulation.
- Harass, threaten, defame, or unlawfully discriminate against anyone, or send hateful, obscene, or abusive content.
- Share credentials or accounts, or let unauthorized people access the Service.
- Access or attempt to access accounts, practices, data, or systems you are not authorized to access.
- Probe, scan, or test the vulnerability of the Service, or conduct penetration or load testing, without CultureNest's prior written authorization.
- Upload or transmit malware, malicious code, or anything designed to disrupt or damage systems.
- Scrape, crawl, or harvest data, or use excessive or unauthorized automation, bots, or scripts.
- Export or exfiltrate data beyond your authorized business need.
- Reverse engineer, decompile, disassemble, or attempt to derive source code, except where the law expressly permits despite this restriction.
- Infringe or misappropriate intellectual property or other rights of others.
- Violate anyone's privacy, or submit personal information without the required authority, notices, or consents.
- Impersonate any person or organization or misrepresent your affiliation.
- Send spam, unsolicited bulk messages, or messages to recipients who have not been lawfully included, or evade unsubscribe or suppression controls.
- Violate export control or sanctions laws.
- Bypass or circumvent usage limits, access controls, domain restrictions, or security measures.
- Use the Service to build or benchmark a competing product, or to gather competitive intelligence, without our written consent.
- Use the Service, its content, or its output to train, fine-tune, or evaluate machine-learning or AI models, except as CultureNest itself provides.
- CultureNest makes no representation that Pulse complies with HIPAA or that CultureNest is or is not a business associate. Contract language alone does not determine business-associate status under applicable law. Customer must determine whether its intended use involves protected health information (PHI), whether a business associate agreement (BAA) is required, and whether Pulse and Customer's safeguards are appropriate for that use. Unless a required BAA is in effect, Customer must not submit PHI to Pulse.
- Use the Service or its output to make high-risk automated employment decisions, or other decisions with legal or similarly significant effects on individuals, without meaningful human review.
2. Enforcement
CultureNest may investigate suspected violations, preserve relevant information and evidence, cooperate with law enforcement, and, with or without notice, remove or disable content, throttle or limit usage, and suspend or terminate accounts, practices, integrations, or access. We are not obligated to monitor use, and our decision not to act does not waive our rights.
